In order to better meet the expectations of its customers, the company Hotel du Cap-Eden-Roc, which manages the e-commerce website Eden-Roc Riviera Collection, has set up a remote sales system via the internet, in parallel with the physical store it operates. Eden-Roc Riviera Collection thus markets worldwide Articles such as ready-to-wear, fashion accessories, shoes, lifestyle products (decor and leisure), as well as jewelry, both for men and women and children, stamped either with the Hotel du Cap-Eden-Roc brand or with partner brands and designers with whom it collaborates (hereinafter referred to as the ‘Article(s)’).
Eden-Roc Riviera Collection also offers Customers a pre-order service that allows them to pay in advance for Articles from custom-made or on-demand productions on its online sales website (hereinafter referred to as ‘the Pre-order’).
In the present General Terms and Conditions of Online Sale, the term ‘Order’ may refer to the Order and/or the Pre-order placed on the Website.
Article 1 - Scope of Application and Acceptance of General Online Sales Conditions
The present General Terms and Conditions of Online Sale apply to all sales of Articles concluded remotely, via the website Eden-Roc Riviera Collection identified by the domain name ‘www.edenrocrivieracollection.com’ (hereinafter referred to as the ‘Website’).
The present General Terms and Conditions of Online Sale also apply to Pre-orders placed on the Website.
The Articles are sold to end customers who are natural persons (hereinafter referred to as the ‘Client(s)’ or ‘you’), acting strictly for personal purposes and unrelated to any commercial activity, thus excluding all resellers and intermediaries acting on behalf of resellers.
Consequently, the Client affirms and declares that they are acting as a consumer and have no intention of reselling the Articles for commercial purposes.
The Client also certifies that they have the legal capacity to commit to the terms of these General Terms and Conditions of Online Sale.
When making each purchase of Article(s) on the Website, the Client must confirm their acceptance of the current General Terms and Conditions of Online Sale by clicking the button ‘I have read the General Terms and Conditions of Online Sale and the Privacy Policy and I accept them.’ These documents are accessible at any time on the Website.
Eden-Roc Riviera Collection and Hotel du Cap-Eden-Roc may update and modify these General Terms and Conditions of Online Sale at any time. Clients will be informed via the update date mentioned at the end of the General Terms and Conditions of Online Sale. The conditions applicable to the sale of Articles are those in effect at the time of order confirmation by the Client.
For more information on the processing of personal data collected on the Site and/or by email by Eden-Roc Riviera Collection and Hotel du Cap-Eden-Roc, the Client is invited to read the Privacy Policy.
Article 2 – Order information
Orders can only be placed on the Eden-Roc Riviera Collection Website; phone purchases are not allowed. The languages available for orders placed on the Website are English and French.
2.1 Orders placed on the Website.
2.1.1 Selection of Articles by the Client
On the Website, the Client selects, enters, and validates the identification and quantity of Articles they wish to order, within the quantity limits indicated in Article 4 below; these Articles are added to their ‘Cart.’
The Client can freely modify their ‘Cart’ online, including removing an initially selected Article, adjusting ordered quantities, or adding an Article by clicking on the corresponding elements in their ‘Cart.’
For Pre-orders, the Client is invited to select Articles and add them to their ‘Cart.’ The Client can freely modify the content of their ‘Cart’ as long as they have not confirmed the order. They can then proceed to identify themselves or act as a guest and validate the content of their order under the conditions set forth in Articles 2.1.2 and 2.1.3 of these General Terms and Conditions of Online Sale.
2.1.2 Identification
Once the Client has completed their selection and wishes to validate the content of their Cart, they can either:
• Log in to their Client account (hereinafter the ‘Account’), or
• Continue as a ‘guest.’
The Client can also log in before selecting Articles.
If the Client already has an Account, they must log in with their unique email address and password.
If the Client does not yet have an Account, they can create one by confirming their name, residential address, email address, and phone number during their order.
The Client will no longer be able to request a modification of their postal address once the order has been placed. If necessary, they should contact Customer Service, which will attempt to address their request.
Further information on the processing of the Client’s personal data is available in the Privacy Policy.
Client identifiers and passwords are strictly personal. Therefore, each Client agrees to keep them secure and never disclose them to third parties.
In case of loss, theft, or any fraudulent use of their Account, Clients undertake to inform Eden-Roc Riviera Collection immediately.
Eden-Roc Riviera Collection cannot be held responsible for any direct or indirect damages caused due to fraudulent access to the Account or the Site or the inability to access them.
2.1.3 Order and/or Pre-order Validation
The Client must validate the delivery method and complete the necessary information for the proper shipment of the order: email address, first and last name, address, postal code, city, phone number, delivery method, billing address, shipping address, and payment information.
The Client can use their shipping address as the billing address or enter a different one.
Once all these information are entered and validated, the price of the Articles (as defined in Article 5 below), any shipping fees, and the estimated delivery date are displayed automatically.
The Client should carefully verify the accuracy of their selection before confirming the order.
Eden-Roc Riviera Collection provides the Client with technical means of verification in the form of a standard summary for completeness and plausibility (allowing verification that all mandatory fields have been filled out and that the characters entered are appropriate for the respective mandatory field) to help the Client recognize any errors they may have made in their entries.
The Client’s order data are then summarized again for final review.
By clicking the ‘Confirm Order and Pay’ button, the Client firmly confirms an order for the Article(s) placed in their Cart.
The Client can only confirm an order after having read and accepted the present General Terms and Conditions of Online Sale and the Privacy Policy by clicking the ‘I have read the General Terms and Conditions of Online Sale and the Privacy Policy and I accept them’ button.
2.1.4 Order Confirmation by Eden-Roc Riviera Collection
Once the steps outlined in Article 2.1.3 above have been completed, an order acknowledgment is sent to the Client via email by Eden-Roc Riviera Collection. In accordance with the provisions of Article 1126 of the Civil Code, the Client accepts the use of email for confirmation of the content of their order by Eden-Roc Riviera Collection. This order acknowledgment does not constitute acceptance of the Client’s order by Eden-Roc Riviera Collection, unless expressly stipulated otherwise.
The order acknowledgment includes the order number, the total amount of the order, information regarding the cost and delivery time, essential characteristics, quantity, and price of the purchased Article(s).
2.2 Order Proof
As a general rule, it is expressly agreed between Eden-Roc Riviera Collection and the Client that emails shall serve as evidence between the parties, as well as the automatic recording systems used by the Customer Relations Service, particularly regarding the nature and date of the order.
Furthermore, in accordance with Article L. 213-1 of the Consumer Code, Eden-Roc Riviera Collection retains the elements related to any order with a total amount equal to or greater than one hundred and twenty (120) euros for a period of ten (10) years and makes them available to the Client upon simple request addressed by the Client to: contact@edenrocrivieracollection.com or to Customer Service Eden-Roc Riviera Collection - Boulevard J. F. Kennedy, CS 10029 - 06 605 Antibes Cedex - France.
However, for orders placed on the Website, it is recommended that the Client also keep a copy (in electronic and/or paper format) of the elements related to their order.
2.3 Pre-order Service
Eden-Roc Riviera Collection’s pre-order service allows Client(s) to purchase custom-made or made-to-order Article(s).
A Pre-order Article is an Article that has not yet been produced. The production process will begin once the Client’s payment for the Article is fully validated. The Client’s credit card will be charged in full at the time the pre-order is placed. Production and delivery times are indicated on the pre-ordered Article’s presentation page.
If any delays or issues arise during the preparation of the Article for shipment, Eden-Roc Riviera Collection will notify the Client via the email address used for the Pre-order and provide available options.
Modifications or cancellations of a paid Pre-order are not possible unless Eden-Roc Riviera Collection informs the Client of a delay or issue. If the Client needs to request a cancellation without having received such notification from Eden-Roc Riviera Collection, they should promptly contact Eden-Roc Riviera Collection’s Customer Service, which will do its best to assist the Client with their request.
If Eden-Roc Riviera Collection cannot ship a pre-ordered Article by the estimated shipping date provided at the time of the Pre-order (or within 30 days following the Pre-order if no estimated shipping date was indicated), Eden-Roc Riviera Collection will notify the Client via email. This notice will explain the available options based on whether and when Eden-Roc Riviera Collection expects to be able to ship the Article.
If Eden-Roc Riviera Collection needs to cancel a pre-order, or if the customer requests cancellation in response to an email providing this option, Eden-Roc Riviera Collection will fully refund the amount of the relevant Article via the original payment method used by the customer within 30 business days following the cancellation. Please note that in this situation, Eden-Roc Riviera Collection is not authorized to issue online credits, vouchers, or exchange another Article for the pre-ordered Article.
It’s important to emphasize that custom-made Articles are not subject to cancellations, modifications, or refunds at the customer’s request unless there is a defect in the Article. Therefore, the 14-day withdrawal period does not apply to these specific orders. If a quality issue is identified upon receipt of the personalized Article, Eden-Roc Riviera Collection encourages the customer to contact our Customer Service.
Article 3 – Availability of Articles
Eden-Roc Riviera Collection reserves the right to change, at any time and without notice, the Article(s) offered on the website, without affecting orders already placed.
Before placing an order on the website, the customer is informed on the page describing each Article about its availability.
If, despite Eden-Roc Riviera Collection’s vigilance regarding stock errors, the ordered Articles are no longer available, Eden-Roc Riviera Collection will notify the customer by email as soon as possible. Refunds via bank transfer lay take up to 30 days to process after order cancellation.
Article 4 – Order Refusal
Purchases made on the website are reserved for customers for their personal use or as gifts, not for resale or commercial purposes.
Therefore, the customer confirms that they are acting as a consumer and do not intend to resell the Articles for commercial purposes.
To ensure better service and availability of Articles, Eden-Roc Riviera Collection limits the number of Articles a customer can purchase in a single transaction and within a 30-day period.
Eden-Roc Riviera Collection reserves the right to refuse any fraudulent or abnormal orders that exceed the specified purchase limits. Additionally, orders from customers involved in disputes related to previous transactions or not in compliance with the Terms and Conditions of Online Sale may also be declined.
If Eden-Roc Riviera Collection identifies that an order does not comply with these Terms and Conditions of Online Sale, the customer will be notified via email If the customer fails to correct any erroneous or conflicting elements within their order within fourteen (14) days of the previous notification, Eden-Roc Riviera Collection reserves to right to cancel the order.
Article 5 – Article Prices - Invoicing
Depending on the currency you have previously selected on the website, the displayed prices are indicated either in Euros (€), US Dollars ($), or British Pounds (£), and include all taxes (VAT), excluding delivery fees, which are shown separately before the order is confirmed.
The invoiced prices are those in effect on the date of the order, subject to the availability of the ordered Article(s) at that moment.
Without prejudice to orders already placed by the customer, Eden-Roc Riviera Collection reserves the right to modify the prices of Articles at any time and without notice.
Please note that the tax refund service is not available for purchases of Eden-Roc Riviera Collection Articles made on the website.
Once the order is paid, the customer will receive an email containing the following information:
• Transaction number,
• Amount paid,
• Article reference and quantity allocated (including shipping fees).
Article 6 – Payment Conditions by Credit Card or Debit Card on the Website
Customer purchases can be made using a credit card or debit card. Cards from the “CB” network, Visa©, MasterCard©, and American Express© are accepted. Cards issued by banks domiciled outside of France must be international bank cards.
After the customer validates their credit/debit card information on the website, they gain access to a secure server operating in SSL mode (128 bits).
The transaction is then carried out by the customer according to banking security standards. Authentication is specific to each bank. By providing their credit card number, expiration date, and cryptogram to Eden-Roc Riviera Collection on the website, the customer agrees in advance and unconditionally that Eden-Roc Riviera Collection will proceed with the secure transaction and authorizes their bank to debit their account based on records or statements transmitted by Eden-Roc Riviera Collection, even in the absence of hand-signed invoices from the cardholder.
The sales contract is concluded at the moment when the order is validated by the Website.
Article 7 – Delivery of Articles
Articles can be delivered worldwide (except for countries at war or limitations imposed by Eden-Roc Riviera Collection’s carriers or partners).
For security reasons, Eden-Roc Riviera Collection will not process any order for which the billing or delivery address is not a personal address (e.g., a post office box, pickup location, or locker).
The customer also has the option to have Articles delivered to another individual when the ordered Article(s) is/are intended as gift(s).
Delivery of the Articles will occur, after the payment of the order amount has been recorded to the delivery address provided by the customer during the ordering process. To this end, the customer commits to providing an accurate delivery address to Eden-Roc Riviera Collection.
The delivery of the ordered Articles will take place, subject to full payment of the price, on the date or within the timeframe indicated to the customer by Eden-Roc Riviera Collection.
The delivery fees, as specified in the order, are covered by the Customer.
In the event of a delivery delay due to circumstances beyond Eden-Roc Riviera Collection’s control, the customer will be contacted as soon as possible, and appropriate measures will be taken. Eden-Roc Riviera Collection will make every effort to minimize delays. However, in the case of significant delays (exceeding 30 days), the customer may contact Eden-Roc Riviera Collection to terminate the contract and obtain a refund for any paid Article that has not been received. In this specific situation, Eden-Roc Riviera Collection commits to refunding any Articles within fourteen (14) days.
In case of delivery failure (after 3 attempts to contact the customer and 3 unsuccessful delivery attempts), and if the package is returned to the carrier’s warehouse due to “NPAI” (Not Living at the Address Indicated), Eden-Roc Riviera Collection will proceed with a refund for the order, and the customer will receive confirmation by email at the address provided during the order placement.
Once the delivery is made to the agreed-upon address, all risks related to the Article are transferred to the customer. Eden-Roc Riviera Collection assumes no responsibility for loss or damage to the purchased Article after delivery.
Upon delivery, the customer must inspect the Article and make written reservations with the carrier if the Article is delivered damaged or does not correspond to the order. In addition to notifying the carrier, the customer has 48 hours to report the same reservations to Eden-Roc Riviera Collection via email at contact@edenrocrivieracollection.com.
Please not that any claims beyond this deadline regarding these reservations will not be considered by Ede-Roc Riviera Collection.

Article 12 – Legal Right of Withdrawal
12.1 Right of Withdrawal
In accordance with the provisions of Articles L. 221-18 and following of the Consumer Code, as a consumer, you have the right to exercise your right of withdrawal within a period of fourteen (14) days without having to justify the reason(s). However, to allow Eden-Roc Riviera Collection to offer Articles that meet your expectations, the customer has the option to specify the reasons justifying the exercise of their right of withdrawal.
The withdrawal period will expire after fourteen (14) days from the day you, or a third party indicated by you (other than the carrier), receive the Article. In the case of an order for multiple Articles delivered separately, the period starts from the delivery date of the last Article in the same order.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from your purchase through an unambiguous statement, as specified in Article 13.
To meet the deadline for withdrawal, simply send your unambiguous withdrawal statement before the expiration of the period.
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal does not apply, notably, to purchases of custom-made or personalized Articles, Articles that have been unsealed and are non-returnable for hygiene or health protection reasons, or Articles whose original nature has been altered after delivery.
Furthermore, in the case of a gift, the right of withdrawal remains exclusively for the customer and cannot be exercised by the gift recipient.
Article 12.2 – Effects of Withdrawal
If you withdraw, we will refund all payments we have received from you, including delivery fees (except additional costs resulting from your choice to use a different type of delivery than the standard delivery offered), within a reasonable period and, in any case, no later than fourteen (14) days from the date we were informed of your decision to withdraw. However, we reserve the right to defer the refund until the Articles covered by the right of withdrawal are recovered.
We will make this refund using the same payment method you used for the initial transaction; in any case, you will not incur any fees due to this refund.
However, Eden-Roc Riviera Collection reserves the right to retain all or part of the price corresponding to the decrease in the value of the Article resulting from handling other than what is necessary to establish its nature, characteristics, and proper functioning.
During the entire withdrawal period, it is strongly recommended that the customer handle and inspect the Article with all necessary care. You will return the Article(s) via the carrier of your choice no later than fourteen (14) days from the date you received the said Article.
To return the Article(s), please contact our Customer Relations Service to obtain the return address to be included on the shipping label. Return costs are borne by the customer.
Article 13 – Return Policy via the Website after Withdrawal

• Be accompanied by a fully completed return form or an unambiguous statement indicating the customer’s decision to return the Articles.
• Include the Articles in their original packaging, in their original sale condition, unused, with all attached Article labels, and all associated accessories or instruction booklets.
Regarding shoes, the sole must also be intact. Therefore, it is strongly recommended to try shoes on a carpet or rug.
A return request is considered invalid by Eden-Roc Riviera Collection when:
• Articles that are not returned or returned incomplete, damaged, without labels, harmed, soiled, or in any other condition that could reasonably suggest they have been used or worn;
• Custom-made Articles and Articles made at the client’s request;

> Download the cancellation form

If Article is returned more than fourteen (14) days after the date of receipt, Eden-Roc Riviera Collection reserves the rights to make no refund, and the Article will be returned to the client at their expense.
Article 14 – Exchange of Articles via the Website
In addition to the client’s right to withdraw, they can also request to exchange an Article within fourteen (14) days - from the date of receipt of said Article - under the conditions specified in Article 13.

• The exchanged Article must bear the same reference as the initially purchased Article. The client must accurately specify the Article they wish to exchange, optionally specifying differences in size or color for replacement Articles.
• The number of replacement Articles must be identical to the number of Articles returned.
• The transportation costs for the initial delivery will be refunded, but the transportation costs for the second delivery will be recharged. The new sale will be subject to the General Terms and Conditions of Online Sale in effect at the time of the exchange.
• The exchange of Articles is subject to the availability of said Articles on the website. In the event that the Article(s) are unavailable, the client will be reimbursed according to the conditions specified in Article 13.
• The Eden-Roc Riviera Collection website does not offer the possibility of obtaining credit on its site.
• Without prejudice to the client’s rights as provided in Article 13, Eden-Roc Riviera Collection reserves the right, as part of its exchange policy, to refuse an exchange beyond two (2) consecutive orders. If a client wishes to exchange Articles that have already been subject to an exchange, they can return the Article(s) by contracting Customer Relations Service via email and receive a refund.
Article 15 – Customer Rights in Case of Defective Articles
In the event of a defect in the Article(s), legal provisions, including statutory warranties, apply. Eden-Roc Riviera Collection and its partners (when relevant) are responsible for non-compliance defects of the Articles (Articles L. 217-4 to L. 217-16 of the Consumer Code) and hidden defects as provided in Articles 1641 to 1649 and 2232 of the Civil Code.
When acting under the legal conformity warranty, the client:
• Benefits from a two-year period from the delivery of the goods to take action.
• Can choose between repairing or replacing the goods, provided that the client’s choice does not result in a cost that is manifestly disproportionate compared to the other option, considering the nature or value of the goods or the significance of the defect.
To benefit from the legal warranties, the client must describe the defect or non-conformity of the product and provide any relevant justification (photos, detailed description of the defect).
The return costs for the defective or non-compliant product will be borne by Eden-Roc Riviera Collection. The product must be returned in its original packaging, accompanied by all accessories and the purchase invoice.
The legal warranty does not cover damages, malfunctions, or defects resulting from:
• Improper use or handling of the Article.
• Normal wear and tear.
• An accident or impact.
• An installation or assembly not in accordance with the manufacturer’s instructions.
• Maintenance or repair performed by third parties not authorized by Eden-Roc Riviera Collection.
Furthermore, the legal conformity warranty applies independently of any commercial warranty that may be granted. Eden-Roc Riviera Collection does not systematically provide a commercial warranty in addition to the legal conformity warranty.
The client can choose to enforce the warranty against hidden defects in the sold Article as defined in Article 1641 of the Civil Code. In this case, the client can choose between cancel in the sale or reducing the sale price in accordance with the Article 1644 of the Civil Code.
Article 16 – After-Sales Service
All technically repairable Articles are eligible for after-sales service.
However, this after-sales service should not be interpreted as a commercial warranty.
In accordance with Article L. 111-4, paragraph 1 of the Consumer Code, Eden-Roc Riviera Collection informs its clients, both before and after order confirmation, about the availability period for essential spare parts necessary for using the Articles.
Eden-Roc Riviera Collection will make its best efforts to satisfy clients in case of requests for one or more spare parts.
Article 17 – Information Regarding Articles
Information related to all Articles offered for remote sale is available on the website.
The photographs, graphics, and descriptions of Articles offered for sale are indicative and do not bind Eden-Roc Riviera Collection. Clients have the option to obtain additional information by contacting Customer Relations Service.
While every effort is made to ensure that the color and pattern of Articles displayed in photos and videos on the website are faithful to the original Articles, variations may occur, especially due to technical limitations in color rendering on your computer equipment. Therefore, Eden-Roc Riviera Collection cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of Articles appearing on the website.
Article 18 – Entirety of the General Terms of Sale and Non-separability of Clauses
The fact that Eden-Roc Riviera Collection refrains from demanding the execution of any provision of these General Terms and Conditions of Online Sale at a given time cannot be interpreted as waiving the right to subsequently invoke total or partial non-performance.
If any provision of these General Terms and Conditions of Online Sale is declared null in whole or in part, the other provisions and other rights and obligations arising from these General Terms and Conditions of Online Sale will remain unchanged and applicable.
Article 19 – Customs

Additionally, please note that when you place an order on Eden-Roc Riviera Collection, you are considered the official importer and must comply with all laws and regulations of the country where you receive the products.
Your privacy protection is important to us, and we advise our international clients that cross-border deliveries may be opened and inspected by customs authorities.
Article 20 – Minors
We do not sell products to minors. We sell products for children to be purchased by adults. If you are under 18 years old, you can only use the Eden-Roc Riviera Collection website under the supervision of a parent or guardian.
Article 21 – Applicable Law and Dispute Resolution
These General Terms and Conditions of Online Sale are subject to French law, except for any mandatory provisions to the contrary arising from Regulation No. 593/2008 of June 17, 2008, regarding the applicable law to contractual obligations (Rome I). This choice of law does not affect the client’s right to benefit from consumer protection regulations applicable in their country of residence.
In the event of difficulties arising during the order or delivery of Articles, the client has the option to seek an amicable solution with Eden-Roc Riviera Collection.
If an amicable solution cannot be reached, the dispute may be submitted to the judicial court of the location of Eden-Roc Riviera Collection’s headquarters.
